The chairman of the Securities Exchange Board of India, UK Sinha announced today that new investors will have to pay an additional Rs 150 for investment of Rs 10,000 and above in mutual funds, while the charge will be Rs 100 for existing investors.
Chairman of the Association of Mutual Funds in India (AMFI) and chief of HDFC Mutual Fund, Milind Barve tells CNBC-TV18 that the decisions taken by SEBI are a good for the future of the mutual fund (MF) industry. “The MF move is not intended to increase cost for distributors. Instead, it is a good step towards regulation of Mutual Fund (MF) distributors in India” he said in an exclusive interview.
Below is a verbatim transcript of his interview of his interview with Shereen Bhan. Also watch the accompanying video.
Q: This will come as a relief for you; specially given the fact that entry load had been done away with under the former SEBI chief Mr Bhave. But how materially beneficial is this going to be for the mutual fund industry?
A: The larger question for us is not to sort of harp on entry load. The real challenge for the industry has been to attract small investors, not just in large cities and metros but also in smaller towns. Also, there was a need for atleast some sort of incentive for the small distributors, typically called as independent financial advisors (IFAs), who were sort of not in the running. I think this is a very positive step because we need to make a step forward towards getting suitable incentives and structure for distributors at the lower end of the curve; not the people who are dealing with large investors or wealthy investors.
Q: Is this incentive enough, Rs 100 and Rs 150 is this incentive enough?
A: I think it is enough because we are looking at small investor’s money and we are looking at a small distributor; that’s exactly the point I am making. I don’t think the objective of this particular move is to create large incentives or big cost to investors. The idea is indeed in the right direction because it is not the intention to increase the cost to the distributors, but at the same time, providing some sort of an incentive for a small distributor. Therefore, the Rs 100, small as it may seem, will be effective because we are looking at small ticket deals and the industry has to focus on the small ticket deals. This is not about large ticket deals, whether it is incentive to sell or not.
Q: Another welcome step in that sense is also the fact that there will no be a single know-your-customer (KYC) norm across various entities and products. Now that should certainly make life simpler and also perhaps bring down cost of compliance, wont it?
A: Yes it is, KYC being done by multiple financial intermediaries in the capital market really put up a lot of burden. Look at it this way, this is not about the fund industry, this is just investor friendly. It is just going to prevent him from repetitively going through the similar process to prove, as KYC does, who he is. I think this is something that is really required and I think it will really help the investor more than any particular industry.
Q: The other thing that the SEBI board has done today is bring in regulations as far as distributors are concerned. All distributors with more than 20 points of presence or who have raised Rs 100 crore from the industry, from the retail or the HNI side, will fall under the ambit. There are several other clauses by which they will fall under the ambit of the regulations, but we don’t have details on what these regulations will be. What do you anticipate?
A: I think asset management companies (AMCs) will be expected to do some due diligence on a regular basis of distributors who meet any one of those three or four criteria. The objective seems very clear- that we make a beginning from bringing under the due diligence process the larger distributors, who indeed do form a significant part of the industries asset under management (AUM).
So I think it’s a good beginning towards distributor regulation. You start from the people who have large share in distribution business, you start from large distributors and basically you would cover them through a due diligence process which is done regularly. You see that they meet the standards of good practices on selling, how to recommend funds, what is the commission structure earned or what are the standards of disclosures.
I haven’t seen really the details of what the regulation is going to be, but when you say something like due diligence, I would expect it to be reasonably broad. If you have distributors who are subjected to some degree of due diligence, it only increases the transparency for the distributors and will only increase the confidence with which investors can then deal with that distributor.
Q: So bottomline, you welcome the move made by SEBI today as a big boost for the mutual fund industry?
A: Yes I do. I think it’s a great move forward and I think we should look forward with it and work closely towards making this effective.

Pakistan Foreign Minister Hina Rabbani Khar arrived at the Jaipur International Airport from Delhi Thursday and after a brief halt due to bad weather proceeded to Ajmer, where she will visit the revered Sufi shrine of Khwaja Moinuddin Chishti.
Airport officials told IANS that Khar arrived here at around 12.30 p.m. by a Pakistan Air Force plane and was received by state government officials.
She was waiting at the VVIP lounge of the airport when it started raining.
"She was to leave for Ajmer by a chopper immediately after arrival, but due to rain, the air traffic control did not give the clearance. So the authorities decided not to take a chance," an airport official told IANS.

Sources said that she stayed in the VVIP lounge and had breakfast. She also discussed with authorities the possibility of going for sightseeing in Jaipur.
However, as the weather improved, she proceeded to Ajmer.
The shrine, dedicated to the Sufi saint who came to Ajmer from Persia in 1192, attracts thousands of pilgrims throughout the year.
After offering prayers at the famous shrine, Khar plans to return to Jaipur and fly back home, ending her three-day visit.
Earlier, Khar, who is in India on her maiden visit as Pakistan foreign minister, had expressed her desire to offer prayers at the Jama Masjid in New Delhi, but this did not work out due to security reasons.
The 34-year-old Khar, Pakistan's youngest and first female foreign minister, had visited India twice before she was appointed the foreign minister over a week ago.
Khar held wide-ranging talks with India's External Affairs Minister S.M. Krishna Wednesday. Krishna invited her to visit south India, specially Bangalore, India's IT hub.

Karnataka lokayukta today submitted his report indicting chief minister BS Yeddyurappa and  family for allegedly taking bribes from mining companies. The BJP summons Yeddyurappa to Delhi. The report indicted Karnataka chief minister BS Yeddyruappa, Reddy and various others and recommended their prosecution under Prevention of Corruption Act and other laws.
In damning evidence against the chief minister, the Lokayukta headed by former Supreme Court judge Justice Santosh Hegde found that a mining company had donated Rs 10 crore to a trust managed by his family members which also sold a piece of land to a mining company for Rs 20 crore far above the guidance value of Rs 1.4 crore.
Hegde's report was handed over by Lokayukta registrar Kunhi Nair Moole to state chief secretary SV Ranganath at the Vidhana Soudha, the state secretariat, about 200 metres from the ombudsman's office on Dr Ambedkar Veedhi (Road).
Hundreds of curious onlookers were outside the Lokayukta office complex, swarming with police personnel.
Moole, who was carrying a suitcase with the voluminous report, had a tough time walking from his car to the Vidhana Souda through the many camera crews jostling with each other to capture the moment.
Ater submitting the report running into 25,228 pages including annexures, Hegde told a press conference that he has named Chief Minister Yeddyruppa, former chief minister and JDS leader HD Kumaraswamy, Reddy brothers (who are ministers and mining magnates), their camp follower and another minister H Sriramulu, Congress MP Anil Lad's wife and over 600 officials in the mining racket that cost the exchequer Rs 16,085 crore between 2006 and 2010.
"Having come to the conclusion that there is as a matter of fact an offence made under the Prevention of Corruption Act I have made a recommendation to the Governor to take further action," Hegde said in respect of the donation made to the trust run by the chief minister's family members.
At another point, he said, "I have made a recommendation for prosecuting everybody. I have stated this to the Governor. It is for him to act."
To a question, he shot back,"Action under Prevention of Corruption Act should be taken. What else?."
The report castigated the BJP government, which is in power since May 2008, for its failure to check irregularities and illegalities in mining in the state.
"The enquiry has found large scale involvement of officials, powerful people both in the Administration as well as in the ground level," said Hegde whose main report runs into 943 pages.
Hegde said in the course of investigations they found that a company dealing in iron ore donated Rs 10 crore to the Trust run by family members of the chief minister.
From the Trust, a mining company purchased an acre of land for Rs 20 crore far above the guidance value of Rs 1.40 crore, he said.
"This payment has been made to the Trust which has nothing to do with the donating company which has not been doing well but borrowed money from another company and donated this. I find this extremly difficult to understand this abnormal high price.
"We have come to an incontrovertible conclusion that this donation and sale consideration has been made for reasons other than genuine reasons." he added.
Replying to questions, Hegde confirmed that the report makes a mention of the CM, his family members, Reddy brothers, Sriramulu and Kumaraswamy and over 600 officials.
In the case of Kumaraswamy, the enquiry found "misconduct" on his part regarding grant of two mining leases and action has been recommended under PCA.
Referring to the purchase of one acre of land in Rachenahalli on Bangalore outskirts for a consideration of Rs 20 crore when its guidance value would not be more than Rs 1.4 crore, he described this as "abnormal payment to a trust which has nothing to do with a donating company which was not financially strong".
Hegde said he found it extrememly difficult to accept that a company which did not have financial resources should borrow from other companies to make donation.
"Therefore, having come to the conclusion that there is an offence under the Prevention of Corruption Act is made, I have made recommendation to the Government to take further steps (against chief minister BS Yeddyurappa) in this regard because the competent authority for taking action against the chief minister is governor of the state".
He said the Lokayukta has submitted the report to the Government and a copy of the report with annexures have been sent to the Governor for "further action" (in regard to the chief minister).
On Reddy brothers, Hegde said contrary to their claim that they were not doing any mining in Karnataka, "we have enough documents to prove to the contrary."
He said the illegalities found were of different types as has been enumerated in different chapters and supported by documents.
"The offences committed by various people and companies will be covered under various acts and action will be taken in accordance with law under IPC, Forest Act, FMRDA and PCA," he added.
Hegde said the Lokayukta has recommended that since various illegalities and irregularities were committed the Government should cancel the mining licenses, compute the quantity of loss and treat it as "stolen iron ore" and recover money from people concerned at the market rate.
The Lokayukta enquiry found that there was rampant illegal mining in Bellary, Chitradurga and Tumkur because of which local people suffered from various problems.
"Once illegal mining is stopped the Central and the State government can recover lakhs of crores of rupees as Excise and VAT," he said, adding over 100 companies were involved in illegal mining.
Hegde has also recommended to the government that security be provided to his team of officers since they could face possible threats from some quarters.
The enquiry team had a huge task in examining four lakh records and collating nearly 50 lakh entries in the effort to produce the report.
